ShortTermLeaseAgreementThisVacationRentalShort-TermLeaseAgreement(thisLeaseAgreement)isalegalcontractbetweentheundersignedperson(s),you-theRenter(alsoreferredtoas“Renters”and“Guests”),andVillaOcalaLLC,aFloridaLimitedLiabilityCompany,(alsoreferredtoas“VillaOcalaLLC”andthe“Owner”.)RaymondRogersistheSoleAgentandManagerofVillaOcalaLLC.WhenandHowConciergeServicesistheLocalManager(alsoreferredtoasLocalContact).TheVacationPropertyislocatedat3150OcalaRdVenice,Florida34293(theVacationPropertyisalsoreferredtoas”VacationProperty”and“VillaOcala”).ThisoccupancywillbeintheformofaVacationRentalonlyandnotconstituteapermanentorprimaryresidenceorothertenancy.Ownerreservestherighttorefuseservicetoanyone.TERMSANDCONDITIONS1.ACCEPTANCE:ThisVacationRentalLeaseAgreement(alsoreferredtoasLeaseAgreement),issubjecttotheapprovalandwrittenacceptanceoftheOwner.PleasereadthisVacationRentalLeaseAgreementthoroughly.AnymoneyreceivedbyOwnerforoccupancyofVacationPropertyindicatestheacceptanceofALLofthetermsandconditionsofthisVacationRentalLeaseAgreement.ItistheresponsibilityoftheRenter(s)tobefamiliarwithallpolicieswithinthisLeaseAgreementandiswhollyresponsiblethatALLGuestsandVisitorsabidebyalloftheTermsandConditions.2.RESERVATIONDEPOSIT:UponyourreceivingyourAcceptanceofReservationbyemailyouwillhave2daystosignandreturntheLeaseAgreementandmakeaReservationDepositdownpaymentof50%oftheTotalRentalCost.YourAcceptanceofReservationemailwillalsocontainalinkforpaymentbyPaypal,CreditCard,orMailinCheck.YouwaiveallrightstobankaccountinterestthatmayaccrueonyourSecurityDeposit.Afeeof$25willbechargedforreturnedchecksonanyamountdue.3.CONFIRMATION:ConfirmationofyourreservationwillbeemailedtoyouafteryourReservationDepositandsignedLeaseAgreementisreceived.Pleasereadtheconfirmationforaccuracyofdates,mailingaddress,numberofadultsand/orguests.YoumustnotifyVillaOcalaLLCofanyerrorswithinonebusinessday.4.PAYMENTINFULL:Paymentinfullisduenotlessthanthirty(30)dayspriortothescheduledarrivaldateandanybalanceduewillbeautomaticallychargedtothecreditcardunlessacancellationnoticeisgivenbyRenterpriorto30daysofthereservationdate.IfTenantfailstotimelypayallmoniesdue,theOwnerreservestherighttoterminatethisLeaseAgreementwithoutnoticetoRenter.5.RENTER,GUESTS,&VISITORSAGE:TheRenter,allmembersoftheRenter’sPartyandany/alloftheirVISITORSmustbeatleast26yearsofage.6.CREDITCARDREQUIRED:Rentersarerequiredtoprovideacopyofavaliddriverslicenseand/orafederal-stateIDandacopyofavalidcreditcardtokeeponfiletopayforrentalbalances,miscellaneouschargesanddamages,shouldtheyoccur.RentersacknowledgeandgivefullconsenttotheOwnerwhomayperformatenantbackgroundand/orcreditcheckathissolediscretionwithoutfurthernoticetoRenter.7.SECURITYDEPOSIT:TheSecurityDepositwillbedetailedontheBookingDetailssectionofthecheckoutwebpageandshallberefundedwithin15daysofyourdeparturedateprovidednodeductionsaremadeduetoA)damage,lossorbreakagetopropertyorfurnishings,B)dirtorothermessrequiringexcessivecleaning,C)anyothercostsincurredbytheOwnerasaresultofyourstay,D)anyupgradesorextrasincludingbutnotlimitedtopay-per-view,poolheating,orconciergeservices.8.CLEANING:AcleaningchargeisincludedinyourTotalRentalCost.Ondepartureleaveallusedbedsstrippedandunmade.Thelastday’stowelsaretobeleftinthebathrooms.Alldinnerware,pots,pans,glassesshouldbecleanedandthedishwasherempty.Floorsshouldbebroomsweptclean,(centralvacinqueenbedrmclosetdoesafastefficientjob).Pleasediscardusedfoodfromthecabinetsandrefrigerator.Trashshouldberemovedfromthehomeandplacedinthelargetrashbarrelinthegarage.IfWedorThrutaketrashbarrelouttothecurbforpickup.Removing,addingorchangingfurniturewithoutOwner’swrittenapprovalshallbedeemedamaterialbreachofthisRentalAgreement,andisstrictlyprohibited.Renterwillbechargedforexcessivelinens,unwasheddishesandanyexcessivecleaningfromtheSecurityDeposit.9.OUTDOORBARBEQUEGRILL:Anoutdoorgrillisprovidedwithpropane.Extrafulltanksareavailableontheproperty.Ifyourunoutpleasecalltheownerorlocalmanagerandaccesstosparetankwillbeprovided.Pleasemakesurethesideburneristurnedoffifyouarenotusingitandbeforeyourcheckout.Thegrillwillbecleanedafterthepreviousrentersandre-linedwithNEWAluminumfoilinthebottomandinthegreasedrippan.Aspartofyourclean-upbeforecheckoutpleasetakeatrashbagoutsideandremovethegreasyaluminumfoilliningfromthebottomandfromthedrippananddiscardinthetrashbag.Pleasebecarefulthatyoudonotdripgreaseonthelanaideck.Wewilltakeitfromthereandre-linethegrillwithnewaluminumfoil.Thiswayeachguestgetstostartwithacleangrillandisresponsibleforremovingtheirowngreasebeforethenextrenter.Leftovergreaseinthegrillwillattractwildlifelikecoyotesorbobcatslookingforaquickmeal,especiallyifnooneishome.Wewilldeduct$25fromyourSecurityDepositifwehavetohaveHouseCleaningremovethegreasylinings.Thank-You.10.DAMAGE:DamagetotheVacationRentalmustbereportedtotheOwnerand/ortheLocalManagerbeforecheck-out.Damagenotcoveredby,orexceedingthecoveragelimitof,theaccidentalrentaldamageinsuranceorSecurityDeposit,isyourfullresponsibility.LossanddamagewillbechargedtheFullReplacementCost.YouexpresslygranttheOwnertherighttochargethecreditcardnumberonfileusedtobooktheVacationRentalforanysuchdamages,including,butnotlimitedto,additionalcleaningfeesforsmokingandpets.Toensurethattheproperpartyisheldresponsible,pleasenotifyyourLocalManagerofanydamagesfoundatcheck-in.BoththeLocalManagerandtheCleaningServicemakecompleteinventory/propertyinspectionsbeforeandaftereachRenterchecks-in/out.Onlytissuepapermaybeflusheddownthetoilet.Renterwillbe100%liableforallplumbingcoststouncloganydrainorsewage/septicpipe.
11.FALSIFIEDBOOKINGS:Ifyourbookingwasmadeunderfalsepretense,including,butnotlimitedto,afalsifiedname,ageorsizeofparty,youwillbesubjecttoimmediateevictionandforfeitureofallamountspaid.12.FEES&ADDITIONALSERVICES:TheOwnerisrequiredtodiscloseallmandatorybooking-relatedfeesintheVacationRentallisting.Insomecases,however,theOwnermayhaveoptionalfeesandservices(e.g.,toheataswimmingpoolinthewinter,conciergeservices).ShouldyouoptintoanyoftheseservicesandrelatedfeestheOwnerwillprovidepaymentdetails.13.MAXIMUMOCCUPANCY:ThemaximumnumberofadultsthatmayoccupytheVacationRentalissix(6).ThisruleappliestoRenter,andallmembersoftheRenter’sParty.Four(4)additionalday“Visitors”26yearsofageorolder.arepermittedbutmustbelistedontheReservationRequestForm.UnlessotherwiseapprovedbyyourLocalManagerorOwner,occupancyovertheindicatedcapacitymayresultinevictionandforfeitureofALLamountspaid.TheLocalManagerisnotauthorizedtomakeexceptionstotheseterms.14.VISITORS:A“Visitor”isanadultoccupantintherentalpropertythatisnotstayingovernight.ThetotalnumberofadultspermittedintherentalpropertyincludingVisitorsisten(10).AnyoccupancyfordailyuseinexcessofthemaximumisaviolationofthisLeaseAgreement.TheRenterissolelyresponsiblethatANYVisitorofANYGuestabidesbyALLoftheTermsofthisLeaseAgreement.AnyviolationofanyprovisionbyanyVisitororGuestwillbeconsideredthesameasiftheRenterviolatedithimself.15.CHILDREN:Ourpolicyisthateveryoneonthepropertymustbeatleast26yearsofage.16.SUBLETTING:SublettingtheVacationPropertyisnotpermissibleandtheRenterisnotallowedtodisclosetheDoorLockCombinationstotheVacationRentaltoanyotherpartythatisnotincludedonthisLeaseAgreement.17.HOLDINGOVER:BecauseofthenatureofOwner’sbusiness(shorttermwinterandsummerrecreationalrentals)Guestunderstands,andisherebyputonnoticethatanyunauthorized“holdingover”ofthepropertypastthestatedrentalperiodcouldseverelyjeopardizeOwner’sbusinessandcauselossofrentalincomefromotherpreviouslybookedguests,temporaryand/orpermanentlossofbusiness,goodwillandreputationand,amongotherthings,couldforceOwnertobreachaLeaseAgreementwithsimilarshorttermsummerandwinterrecreationalGuest(s)whomayhavereservationsduringGuest’sunauthorized“holdingover”period.Intheevent,Ownermaybelegallyliableindamagestosaidotherguests.Guestsshouldbeawarethatunauthorized“holdingover”hasbeenconstruedasafactorinestablishing“maliciouscontinuingoccupation”ofrentalproperty,whichmayentitleOwnertotrebledamagesinanyunlawfuldetainedaction.Guestalsorecognizestheunauthorized“holdingover”couldbegroundsincourtasacauseofactionforintentionallyinterferingwithOwner’sprospectivebusinessadvantage.Inaddition,wewillcharge$100.00anhourpast11:30a.m.ondayofcheckout.18.USEOFSECURITYCAMERAS:Rentersunderstandandacceptthatthepropertyisprotectedwith3active,outsidesecuritycameras.Thesecamerasareusedtoprotectthepropertyfrompotentialbreak-insandtheft,andtoallowtheOwnertoinspecttheoutsidegroundsformaintenanceandlandscapingissues.ThereareNOcamerasinsidethehouseorpositionedtoviewanypartofthelanai,swimmingpoolorpoolcage.Thelocationofthesecamerasalsopreventsanyofthemfromviewingthruanywindowontheproperty.19.QUIETTIME:Quiettimeis9PM.Rentersunderstandthatthisisaquietfamilyneighborhoodwithmanywhogotobedearlyandgetupearlytogotowork.Renters,Guests,andtheirVisitorsagreetorespecttheprivacyandquietserenityoftheneighborhoodespeciallyintheeveningandnighthours.AnycomplaintsfromneighborstotheOwnerorLocalManagerwillbetakenveryseriously.20.NOPARTIES/EVENTS:Thisisnotawildpartyhouse.Excessivedrinking,loudmusicornoise,Wedding/promparties,fraternityorsororityparties,graduationpartiesandthelikearenotallowedatanytime.Adultscannotrentpropertyonbehalfofunderageguests,noexceptions.Honeymoonersarecertainlywelcomed.21.NON-SMOKING:Thisisa100%NONSMOKINGvacationpropertyinside,outside,andanywhereontheproperty.AnytypeofEvidenceofSmoking,suchasthesmellofcigarette,cigar,pipe,vaping,marijuana/medicalmarijuanaorANYothersmokeinsideoroutsidethehomethatisnotedbythecleaningcreworLocalManagerissufficientbasistochargetherenterforsmokecleanupandremovalfromcarpeting,ACducts&filters,beddingandfurniture.ThisRentalLeaseAgreementwillbeimmediatelyforfeited,terminatedanddepositswillberetainedandadeepcleaningfeeof$1000.00willbeimmediatelychargedtotheCreditCardonfileandtheGuestsandVisitorswillberequiredtoimmediatelyvacatetherentalproperty.22.NOPETSALLOWED:Ifyoubringapet(s),thisRentalLeaseAgreementwillbeimmediatelyforfeited,terminatedanddepositswillberetainedandadeepcleaningfeeof$1000.00willbeimmediatelychargedtotheCreditCardonfileandtheGuestsandVisitorswillberequiredtoimmediatelyvacatetherentalproperty.23.VEHICLES:Maximumof3vehiclesareallowedtobeparkedonthedriveway.Allvehiclesarerequiredtoberegisteredandinproperworkingorder.Anyrepairsormaintenancetoanyvehicleonthepropertyisnotpermitted.Renterisresponsibleforanyleakageordamage/stainfromanyfluidfromanyoftheRenter’s,Visitors,orGuest’svehiclesparkedontheproperty.DamagetoanyofthedrivewaypaverswillbeassessedtotheRenter’sCreditCardonfile.RenterandhisGuestsareprohibitedfromparkingboats,boattrailers,motorcycles,recreationalvehiclesorcommercialtrucksinthedrivewayoroutonthestreetinfrontoftheproperty.Thesevehicleswillbetowedimmediatelyfromthepropertyattheowner’sexpense.24.CONDITIONOFPROPERTY:Ownershave,tothebestoftheirability,givenanaccuratedescriptionofthepropertyanditscondition.Guestunderstandsthatitisconsideredasreserved“sightunseen”.Ourcleaningstaffwillhavecleaneditbeforeyouroccupancy.Allelectrical,plumbingandappliancesshouldbeinworkingorderalthoughtheOwnerdoesnotguaranteeagainstmechanicalfailureofanyappliance,electricalservice,stoppedplumbing,watersupply,heating,orairconditioning.Thefailuresofoperationofanyoftheseandcertainextraamenities,suchasTVs,soundsystem,cable,pool,Jacuzzi,Whirlpool,ortheInternetandWiFiservicearenotabasisforanyrefund.OwnerwillmakeeveryefforttohavetheseitemsrepairedbutdoesnotguaranteethattheywillberepairedduringGuestsoccupancy.Whenyouarrive,ifyoufindthatthehousehasnotbeencleanedtonormalstandardspleasenotifytheOwnerimmediately.Wewilldoourbesttohavetradesmenattendtothe
problemsbutmaynotbeabletofixeverythingoverholidaysandweekends.Undernocircumstanceswillanyoftherentalmoneyberefundedorreturnedbecauseoftheconditionofthehouse.TheGuestagreestoholdtheOwnerharmlessfromanyliabilityfortheconditionofthehouse.25.MAINTENANCE:TheOwnercaresverymuchabouttheirVacationRentalandstrivestokeepitinexcellentshape.Ifyounoticeanyproblemsormaintenanceissues,pleasenotifyyourLocalContactimmediately.Tenantisrequiredtoreportanydeficiencyordamageintheunitimmediatelyaftercheckingin(within24hours).AformisprovidedinyourwelcomepackagetocompleteandnotifytheLocalManagerorOwner.RentershouldimmediatelycallortexttheOwnerat508726-9799andleaveadetailedmessageonthevoicemail.Rentermaybeheldresponsiblefornotreportinganyissuesinatimelymanner.Rentermaybeheldresponsibleforneglectingtooperateappliancesinthepropermanneranduseforwhichtheyareintended.TheOwnerandtheLocalManagerandtheiragentswillberequiredtoperformnecessarymaintenanceprojectsonthepropertyduringvarioustimesoftheyearsuchasweeklylandscaping,poolcleaning,andpestcontrol.MaintenancestaffwilldothebesttheycantonotdisturbtheRenter’svacation;however,thereisnoguaranteethatmaintenancewillnotbeperformedonthepropertyduringRenter’sstay.Therewillbenorefundsordiscountsduringanyrepairormaintenanceprojects.26.ENTRYOFPREMISES:WithGuest’spermission,whichisherebygiven,OwnerorLocalManagermayenterthepremisesduringreasonabledaylighthourswithoutsecuringpriorpermissionfromGuest,butshallgiveGuestnoticeofsuchentryimmediatelypriorifpossibleandimmediatelythereafter.ForinventoryandmaintenancepurposesapropertymanagementemployeeoftheOwnermayneedtoenterthepremises.Thesamepermissionprocedureappliesasabove.Inanyemergency,OwnerorOwner’sservicingagentsmayenterthepremisesatanytimewithoutpermissionofGuestforthepurposesofmakingrepairstoalleviatesuchemergency.IfGuestabandonsorvacatespremises,Ownermay,athisoption,terminatethisLeaseAgreement,re-enterthepremisesandremoveallGuest’sproperty.27.ASSUMEDRISKS:TheRenter,GuestsandtheirVisitorsassumeallrisksrelatedtotheuseofanyprovidedHotTub,JacuzziTub,WhirlpoolorSwimmingPoolincludinganyillness,injury,ordeath.28.SLIPANDFALL:Renters,GuestsandtheirVisitorsassumeallriskforanyinjurycausedbyaSlipandFallonanywetsurfaceoftheRentalProperty.VillaOcalahastilefloorsthroughoutwhichmaybeextremelyslipperyforwetfeet.Floorsinbothbathrooms,thekitchenandpooldeckareslipperywhenwet.Wetfeetfromthepoolenteringthehouseorwetfeetgettingoutoftheshoweroreitherbathtubmayeasilycauseanunexpectedfallandseriousinjury.VillaOcalahasnonslipmatsandgrabbarsinthebathroomsandlivingroomentrancefromthepooltouse.Nooneatanytimeshouldwalkontilesurfaceswithwetfeet.Therentersareresponsibletobringnonslipfootweartouseandpreventanyslipandfall.29.CHILDPROOFING:Rentersunderstandthatno-oneundertheageof26isallowontheproperty.Nospecialaccommodationshavebeenmadeto“childproof”thishouseorproperty,andtherenterassumes100%oftheriskorharmtoanychildtheRenterallowsonthepropertyinstrictviolationofthissignedlease.Theserisksarenotlimitedto,butincludeaccesstotheocean,pool,tubs,adjacentstreet,electricaloutlets,cleaningsuppliesinthehouseorplantsinthehouse,patio,orpropertythatmightbepoisonousifingested.Nochild-relatedsuppliessuchashighchairs,cribs,changingtables,etc.areprovided.Bitingandstinginginsectsareverycommonatalltimesoftheday.Venicehaswildlifesuchaslargepreyingbirds,bobcats,apackofwildcoyotesinthevacantlandjustNorthofOcalaRdanddirectlyEastoftheVeniceAirport.,alligators,largesnakesandsharksthatposedangertochildrenandun-assumingadults.Thedatenutpalmshavelongneedlelikespikesthatwillinstantlypunctureanythingthattouchesit.Thereareotherharmfulhazardsnotincludedonthislist.30.PERSONALPROPERTY:RenterunderstandsthatanypersonalpropertyofandusedbyRenter/GuestisnotinsuredbyOwner.TheOwnershallnotberesponsibleforanylost,stolenormissingpropertyoftheRenter/GuestorpropertyofGuestleftaftercheck-out.31.BEACHCONDITION:GuestunderstandsthatOwnerhasnocontrolovertheconditionofthebeachandcannotbeheldliableforanychangestobeachconditionsoranyclosingasorderedbyanyofficialagency.32.USEOFEXTRAS:Renterswillfurnishtheirownbeachtowels,beachchairsandbeachshades.However,theownermakesavailableextratowelsandlinenstohandleunusualcircumstancesorneedsincludingafewbeachtowels.Theseextraitemsareprovidedinthemasterbathroomlinencloset.IfRentersuseanyoftheseitemstheywillwash,dryandreturnthemtotheirpriorlocationorRenterswillbeassessedacleaningfeeof$50.00.Anyunusedbedswillbeleftasfound.Leaveusedbedsunmadeandusedtowelsonthebathroomfloororlaundryroom.Donotattempttolaunderquilts.33.PRIORAGREEMENTS:NopriorLeaseAgreementorunderstandingnotcontainedinwritinghereinshallbeeffective.Furthermore,Owner,otherthanwhatisspecificallywrittenandsetforthherein,makesnootherorfurtherrepresentationregardingthenature,characterandqualityofthepremisestoberented,andnorepresentationshallbedeemedtoexistorbematerialunlessanduntilitisreducedtoawrittenformandsignedbytheparties.ThisRentalLeaseAgreementmaybemodifiedinwritingonly,andmustbesignedbythepartiesininterestatthetimeofthemodification.ItconstitutestheentireLeaseAgreementoftheparties.Ifanyprovisioninthiscontractheldbyanycourttobeinvalid,voidorunenforceable,theremainingprovisionsshallneverthelesscontinueinfullforce.34.ASSUMPTIONOFRISK:Nolifeguardisonduty.Accordingly,personsusingthebeachorSwimmingPool,Jacuzzi,orWhirlpooldosoattheirownriskandtheownerassumesnoresponsibilityforaccident,injuryordeath.Nooneshouldswimalone.RenterswillholdtheOwnersharmlessfromanyandallbodilyinjuryand/orpropertydamageincurredonthepropertyarisingoutofRenters’negligentactsoromissions.Seedisclaimerbelow.35.INDEMNIFICATION&HOLDHARMLESS:YouagreetoindemnifyandholdharmlessVillaOcalaLLC,theOwner,RaymondRogersortheLocalManagerforanyliabilities,damage,costorexpensewhatsoeverarisingfromorrelatedtoanyclaiminconnectionwithyouruseand/oroccupancyoftheVacationRental,orthefailureofyouandyourGuestsorVisitorstoobservetheRentalRegulations,including,butnotlimitedto,anyclaimorliabilityforpersonalinjury,damage,lossofpersonal
